This application for anticipatory bail arises out of Kahalgaon P.S. Case N0. 195 of 2017, disclosing offences under Sections 147,353,332,337,338,427,379,511 of the Indian Penal Code.

The Informant is an Officer of Central Industrial Force posted at Kahalgaon. It is alleged in the First Information Report that he along with a police party was escorting the coal rake from T.P.S. Kahalgaon to Kahalgaon Railway Station when the persons named in the First Information Report started pelting stones on the police party. The informant is said to have received injury out of that.

From the First Information Report, I find that the

Patna High Court Cr.Misc. No.46429 of 2017(2) dt.03-10-2017 2/2 allegation is of omnibus and general in nature. Considering the facts and circumstances of the case, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kahalgaon P.S. Case No. 195 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
