JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rupaspur P.S. Case No. 13 of 2018, dated 11.01.2018, instituted for the offences punishable under Sections 420, 384 and 385 of the Indian Penal Code. The petitioner and his father are said to have prevented the complainant/informant from raising construction over a plot of land which she had purchased for valid consideration from the father of the petitioner. It has been alleged that the complainant/informant was abused and was also fired at, but no injury was received by her. Learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.33916 of 2018 (2) dt.05-07-2018 2/2 that the complainant/informant had, no doubt, purchased a plot of land from the father of the petitioner, but she was trying to encroach upon the land which was contiguous to the aforesaid transferred land and which had not been sold to her. As a result, the father of the petitioner had to file a Title Suit No. 4062 of 2017 for the declaration of his/petitioner's title over the plot of land over which the complainant/informant intended to raise construction. The petitioner is also stated to be physically challenged by 30%.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Chief Judicial Magistrate, Danapur, Patna in connection with Rupaspur P.S. Case No. 13 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
