The petitioner seeks anticipatory bail in connection with Naubatpur P.S.Case No. 555 of 2018, registered under Sections 448, 341, 354 (B), 323, 504 and 506/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is of trying to outrage her modesty and the petitioner along with other accused persons came to her house and assaulted her father, mother and grandmother and also threatening to kill them. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and as per F.I.R. the entire allegation against the petitioner under Section 354 (B) of the I.P.C. is false and the petitioner has no criminal antecedent.

No.22403 of 2019(2) dt.09-04-2019 2/2 Learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail and there is direct allegation against the petitioner of catching hold the hand of the informant on road and also assaulting the father and mother of the informant.

Having considered the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of six weeks from the date of receipt of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court and if possible to be disposed of on the same day.

This application is accordingly disposed of.
