2. The petitioner has preferred this application for grant of regular bail in connection with Sadar P.S. Case No. 1196 of 2023 dated 03.12.2023 registered for the offences punishable u/ss 411, 413, 414, 120B, of the Indian Penal Code and 20(b) (ii)(B) of N.D.P.S. Act.

3. As per the prosecution case, 60 gms charas like substance, Rs. 4900/-, two mobile phones were recovered from the possession of the petitioner. It is further alleged that the two motorcycles were also recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

No. BR06AQ-1281 belongs to the petitioner and the other articles that is Rs. 4900/- and two mobiles are the personal property of the petitioner. It is further submitted that the seized contraband is less than the commercial quantity. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.12.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Sadar P.S. Case No. 1196 of 2023.

7. The application stands allowed.
