KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 13-05-2022 Petitioner has prayed for the following relief(s): " (i) For issuance of an appropriate writ/writs directing the concerned Respondent/Bank to give four years time for payment of loan amount in installment considering the case of the Petitioner' pathetic financial conditions and heavy loss occurred due to closure of his shop due to the COVID Pandemic as the shop of the petitioner has remained closed/locked down on the decision of State Government of Bihar and since 23.03.2020 for more than one and half years.

(ii) Any other relief/reliefs may also be granted in favour of the Petitioner for which he is found entitled for in the facts and circumstances of the case."

Patna High Court CWJC No.4980 of 2022 dt.13-05-2022 2/2 In view of the fact that Debts Recovery Tribunal is now functional, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition with liberty to take recourse to such other appropriate remedies, as are otherwise available, in accordance with law. Permission granted.

As and when any such request is made by the petitioner before the Tribunal, the same shall be considered and decided expeditiously.

The petition stands disposed of as withdrawn with the liberty aforesaid.

Interlocutory application(s), if any, shall also stand disposed of.
