The petitioners are apprehending their arrest in connection with Malsalami P.S. Case No. 209 of 2010 for the offence under Sections 302 and 34 of the I.P.C. and Section 27 of the Arms Act lodged on 04.11.2010 by the informant Yogendra Ray.
The prosecution story, in brief, is that on 04.11.2010, the informant was selling milk near Madho Mills. In the meantime, some people came and said that his child, Chunnilal Yadav has died. Thereafter, the informant rushed towards the alleged place of occurrence and saw his son dead with bullet injury in his head. Then, the police came and he also asked about the culprits but no one told about them. The police took away the dead body of his child to N.M.CH.
Patna High Court CR. MISC. No.17123 of 2023(2) dt.24-05-2023 2/2 The name of the petitioner came during the course of investigation but he evaded arrest for one decade. In view of the fact that the matter is of 2010 and after a decade, the prayer for anticipatory has been made by the petitioner, no relief can be granted.
Accordingly, the petition stands rejected.
