This is an application seeking anticipatory bail in a case registered for the offence punishable under various Sections of the Indian Penal Code including Sections 307, 504 and 506/34. As per the prosecution story, the petitioners and other coaccused, nine in number, assaulted the informant and his family members. On the basis of such allegation, Digha P.S. Case No. 94/2014 came to be registered. He submits that prior to institution of the said case, an F.I.R. was got instituted by the petitioner's side being Digha P.S. Case No. 93/2014. He further submits that there is civil dispute between the parties, which is the reason behind institution of the case and counter case. He further
Patna High Court Cr.Misc. No.32328 of 2014 (2) dt.21-01-2015 P2/2 submits that the dispute between the parties has been substantially resolved.
Be that as it may, in the facts and circumstances of the case and keeping in view the nature of allegations and the injury report, let the petitioners above named, in the event of their arrest / surrender within six weeks from today before the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount, each to the satisfaction of the learned Judicial Magistrate, 1st Class, Civil Court, Patna, in connection with Digha P.S. Case No. 94/14, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
