ANJANA MISHRA ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner is in custody since 26.03.2018 in connection with Asthawan P.S. Case No.56 of 2018, registered under Section 414/34 of the Indian Penal Code.
The learned counsel for the petitioner submits that he is the owner of a mobile repair shop and it is not unnatural that other mobile phones will be present at shop. It is submitted that whatever mobile has been recovered from the petitioner shall be belong to customers and it is not possible for the petitioner to desert which is stolen mobile for a genuinely owned mobile. It is further submitted so far as the allegation regarding stolen motor cycle is concerned, the petitioner has no connection with the same.

No.34185 of 2018 (3) dt.05-07-2018 2/2 In view of the aforementioned facts and circumstances and also because the petitioner has got no criminal antecedent, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Biharsharif, Nalanda, in connection with Asthawan P.S. Case No.56 of 2018.
