====================================================== CORAM: HONOURABLE MR. JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 14-01-2015 The Vice-Chancellor of the Patna University is present in person and it is apparent that it is his office, which has put him in this predicament. The orders of this Court and the Division Bench in appeal were clear. There was no ambiguity but someone in the office was not inclined to make the payments in spite of orders of this Court and the Division Bench due to which payments were withheld. Payments were made long after delay and the result was that University had to pay interest for the delayed payment.

Mr. Ashok Kumar Keshari, learned counsel for the University, states that interest amounting to Rs.5,28,584.00, as calculated by them, has been paid to the petitioner on 13th of January, 2015 i.e. yesterday. It is regrettable that because some officer chooses to have a confused frame of mind, the State and

Patna High Court MJC No.6043 of 2013 (03) dt.14-01-2015 2/2 the University become liable to pay interest for his confusion or inaction.

Be that as it may, no tax payers' money can be spent for meeting the laches by any officer. The Vice-Chancellor would identify the officers who are responsible for the delay in payment, for which incurred payment of additional interest and would recover the amount of interest from those persons after due enquiry and report to this Court within one month. If the petitioner has any grievance with calculation or interest thereof and with regard to arrears of payment, he may bring this fact to the notice of the learned Vice-Chancellor, who would get the same examined and take appropriate steps.

With these observations and directions, this contempt petition stands disposed of.
