At the very outset, it is pointed out on behalf of the petitioners that petitioner Nos. 1 & 4 have already been arrested and therefore, their prayer for anticipatory bail has become infructuous.
Accordingly, prayer for anticipatory bail of petitioner Nos. 1 & 4 stands dismissed being infructuous.
The petitioner Nos. 2 & 3 apprehend their arrest in connection with Mansi P.S. Case No. 220 of 2013 registered under Sections-147, 447, 379, 504 of the Indian Penal Code and Section-
Patna High Court Cr.Misc. No.32073 of 2014 (2) dt.03-02-2015 2/2 27 of the Arms Act.
So far as aforesaid petitioner Nos. 2 & 3 are concerned; no specific overt act has been attributed against them and it appears that the alleged occurrence took place on account of land dispute. Taking into consideration the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioner Nos. 2 & 3, namely, Anil Yadav son of Bhuneshwar Yadav and Sanjeev Kumar S/o Biranchi Yadav are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mansi P.S. Case No. 220 of 2013 to the satisfaction of Chief Judicial Magistrate, Khagaria subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
