JUSTICE SANDEEP KUMAR ORAL ORDER 12-05-2025 As both these bail applications arise from the same police station case, hence, with consent of parties, they are being heard together and disposed of by this common order.
2. Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the

3. These applications are for grant of regular bail in connection with Bhagwanpur P.S. Case No.330 of 2024, registered for the offences under Sections 316 (2), 318(4) of Bhartiya Nyaya Sanhita.
4. As per the F.I.R., informant is one Md. Ashif and he has alleged that on 24.11.2024 at 11:35 P.M, he loaded ghadi detergent worth Rs.12,49,511/- in a truck bearing No.BR 01 GB 8422 at Bithauli Sarai, Bhagwanpur, Vaishali. The name of the truck driver was one Sanjay Paswan. Rs.39,000/ fare was agreed between them and on demand of the driver Rs.30,000/- was paid to the driver from phone number- 7352765786 to phone number- 8757808456 in the account of Sanjiv Kumar. The goods were to reach Siliguri by 26.11.2024 but it has not reached there. The informant found that the mobile of the driver is switched off. The complexity of the two petitioners i.e. Pankaj Kumar @ Pankaj Prasad and Shashi Ranjan @ Shashi Ranjan Azad has come during investigation.
5. The petitioner Pankaj Kumar is in custody since 08.12.2024 and has two criminal antecedents and petitioner Shashi Ranjan is in custody since 08.12.2024 and
3/4 has one criminal antecedent.
6. Petitioner namely, Pankaj Kumar can be seen standing near the truck at the time of loading of the goods in the CCTV footage. The number of the truck was changed and the number of registration number of the truck which was used in the crime is BR-01-GB-8422. Pankaj Kumar had created a fake driving license in the name of Sanjay Paswan and he is the driver of the truck. Pankaj Kumar has been identified in the CCTV footage by the Chaukidar of Ekangarsarai. The family members of Pankaj Kumar have also said that he is the driver of truck no. BR-01-GH-3737 and he holds a mobile and his mobile number is 7070794508.
7. From the analysis of the CDR, the tower locations of the mobile has been found in Bhagalpur and Pankaj Kumar was arrested. Pankaj Kumar in his self inculpatory statement has named the petitioner Shashi Ranjan, with whom he had conspired to steal the entire goods of more than Rs.12,00,00/- thereafter they changed the number of the truck and after forging driving license they have committed the crime. The purchaser of the goods in question is one Santosh Kumar, who has not been arrested by the police.

8. Considering the gravity of the offence and materials available on record, I am not inclined to extend the privilege of regular bail to the petitioners.
9. Accordingly, these applications are dismissed.
10. The Superintendent of Police, Vaishali is directed to supervise the case himself so that other coaccused persons are arrested at the earliest.
11. Let a copy of the order be communicated to the Superintendent of Police, Vaishali forthwith through FAX or e-mail for its compliance.
