Petitioner seeks regular bail in connection with Rafiganj PS Case No. 251/2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act.

460 litres of illicit liquor is said to have been recovered from the husk house of one co-accused, Shivpujan Yadav.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case merely on the basis of suspicion. No illicit liquor has been recovered from his conscious possession or from the premises belonging to him. Further submission is that a similarly situated accused person, Vikash Yadav has been granted anticipatory bail by a Bench of

Patna High Court CR. MISC. No.17530 of 2022(2) dt.26-05-2022 2/2 this Court vide Cr. Misc. No. 2962/2020(Annexure-2). He is in custody since 09.02.2022.

Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that the similarly situated co-accused person has been granted anticipatory bail by a Bench of this Court, the petitioner is in custody since 09.02.2022, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No.1, Aurangabad (Bihar) in connection with Rafiganj PS Case No. 251/2019 .
