The petitioner seeks bail in connection with Dhaka Police Station Case No. 133 of 2018 registered under sections 380,511,354 (B),441,451 of the I.P.C and 37 (B) of the Bihar Prohibition and Excise Act 2016.

The petitioner is said to have made an attempt to commit theft of licencee gun of the informant intruding into his house in inebriate condition in the night and on asking of the family members he misbehaved with the grand daughter of the informant on the point of dagger.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case by the

Patna High Court Cr.Misc. No.33486 of 2018 (3) dt.20-06-2018 2/2 informant due to animosity. No such occurrence as alleged ever took place. He happens to be the tee-totaller and had not consumed any liquor. Neither any independent witness nor the victim had corroborated the factum of making attempt to commit theft of the licencee gun of the informant and teasing the victim by the petitioner rather they have stated that the petitioner had intruded into the house of the informant in inebriate condition along with grand son of the informant. Petitioner has no criminal antecedent. He has been languishing in custody since 29.04.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge cum Special Judge, Excise, East Champaran, Motihari in connection with Dhaka Police Station Case No. 133 of 2018.
