This application for anticipatory bail, arises out of Pipra Police Station Case No. 112 of 2016, disclosing offences punishable under Sections 376, 504 and 506 of the Indian Penal Code.

A complaint petition filed by the informant is the basis for registration of the First Information Report, according to which, the occurrence of an attempt to commit rape had taken place on 27.04.2016. More than a month thereafter on 02.06.2016, the said complaint case was filed. I am tentatively satisfied with the submission made on

Patna High Court CR. MISC. No.18800 of 2019(2) dt.28-03-2019 2/2 behalf of the petitioner that the allegation as has been made in the complaint petition appears to be improbable. On perusal of the complaint petition, in my opinion, a case for grant of anticipatory bail is made out. This application is accordingly allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-III, Supaul in connection with Pipra Police Station Case No. 112 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
