Petitioner, already in custody, seeks bail in connection with Ramgarh (Nuawn) P.S. Case No.313 of 2017 registered under Section 414 of the Indian Penal Code as well as under Sections 25(I-b)a, 26 and 35 of the Arms Act. Allegation in brief is that three unknown miscreants after looting the informant escaping away but chased by the police and apprehended.
Learned counsel for the petitioner submits that there is no recovery of any money from possession of the petitioner except recovery of a mobile which is not robbed one, that is his personal mobile and rest two persons apprehended with the
Patna High Court Cr.Misc. No.33683 of 2018(2) dt.25-06-2018 2/2 petitioners Sudhir Kumar, from whose possession Rs.45,000/- was recovered and one Rajendra Chaudhary from whose possession one loaded country made pistol was recovered, have been admitted to bail by different coordinate Benches of this Court vide orders dated 23.03.2018 and 17.05.2018 passed in Cr. Misc. Nos.5274 of 2018 and 26769 of 2018 respectively and prior to that the petitioner had no criminal antecedent but subsequently made accused in two other cases and the petitioner is in custody since 09.11.2017.
Having considered the aforesaid facts and circumstances, petitioner Ranglal Chaudhary is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Ist Class, Kaimur at Bhabua in connection with Ramgarh (Nuawn) PS Case No.313 of 2017.
