The petitioner, in the present case, is seeking regular bail in connection with Giriak P.S. Case No. 117 of 2018, registered for offences alleged under Sections 379, 461, 411 of the Indian Penal Code and Sections 25 (1-b)a / 26 / 35 of the Arms Act. It is submitted on behalf of the petitioner that the petitioner was not arrested on the spot rather the co-accused who were arrested have disclosed the name of the petitioner, however, nothing incriminating have been recovered from his possession and the co-accused Rajesh Mistri has been granted privilege of regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 32740 / 2018.
Patna High Court Cr.Misc. No.34112 of 2018 (2) dt.13-06-2018 2/2 Learned APP for the State is present.
Considering the facts and circumstances of the case whereunder the petitioner was not arrested on the spot and he has got no criminal antecedents, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bihar Sharif, Nalanda in connection with Giriak P.S. Case No. 117 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
