Arvind Kumar v. The State Of Bihar And ORS
IN THE HIGH COURT OF JUDICATURE AT PATNA
Letters Patent Appeal No.2057 of 2016 In Civil Writ Jurisdiction Case No. 17178 of 2014 ====================================================== Arvind Kumar .... .... Appellant/s
Versus
The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance :
For the Appellant/s : Mr. Bipin Kumar For the Respondent/s : Mr. Raj Ballav Pd.Yadav-Aag11 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 19-06-2017 From the facts available on record, it is crystal clear that the petitioner's father died in harness while working in the work charge establishment. Before his case for regularization of service could be considered by the competent authority on the basis of government notification dated 4.112.2013. He died on 23.12.2013. That being so, the claim of the petitioner for compassionate appointment could not be considered as his father was an employee in the work charge establishment. That being the position, we find no error in the impugned order. Accordingly, this appeal is dismissed.
