JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being mother and brother of the husband of the victim and mediator of the alleged marriage are apprehending arrest in a case registered for the offences punishable under Sections 498A,120B and 304B of the Indian Penal Code.

The accusation is of killing the daughter of the informant after two years of marriage for non fulfillment of dowry demands.

It is submitted that the accusation against the petitioners is omnibus and general. The victim died due to snake bite. It is further submitted that the victim died on 20.6.2013 whereas the complaint was filed on 26.6.2013 which came to be registered as

Patna High Court Cr.Misc. No.31909 of 2014 (2) dt.03-02-2015 2/2 police case on 9.9.2013 and the informant participated in the cremation. Considering the aforesaid facts, the husband of the victim has been granted regular bail vide Cr. Misc. No. 11726 of 2014 by this court.

Considering the delayed lodging of the case, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Dumraon P.S. Case No. 189 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
