This is an application for bail in connection with Bakhari P.S. Case No. 136 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is that they were armed with pistols and co-accused Prabht Yadav made firing causing death of mother of informant.
Submission of learned counsel for the petitioners is that there is land dispute between the parties from before and there is no specific allegation of firing against them and further submission is that whole family members have been implicated in this case and they are in custody for more than three months.
Patna High Court Cr.Misc. No.45104 of 2017 (3) dt.17-10-2017 2/2 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioners at this stage. However, once charge has been framed in this case, learned trial court will release the petitioners on bail to its own satisfaction on the condition that they will co-operate in trial and will appear on each and every date, failing which their bail bonds shall be liable to be cancelled.
With the above observation, this application is disposed of.
