JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 This application, for grant of anticipatory bail, arises out of Kharagpur P.S. Case No. 429 of 2018, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code. Allegation as per F.I.R is that petitioner passed matriculation twice first in the year 1980 showing himself to be born on 1.1.1964 and secondly in the year 1994, in which, he had shown his date of birth as 14/4/1976 and on that basis, he secured the appointment as a teacher.
Submission of learned counsel for the petitioner is that there is no allegation that his certificate is not genuine rather the allegation that he appeared in matriculation twice by changing his date of birth, however, the petitioner has only once appeared in the examination of matriculation in the year 1994. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Munger, in connection with Kharagpur P.S. Case No. 429 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
