The petitioner is apprehending arrest in a case registered for the offences punishable under sections 420,414 and 120B of the Indian Penal Code and sections 4 and 5 of Explosive Substances Act.
On secret information, raid was laid when three persons were found standing on the road in suspicious condition who were apprehended and on their information, a large number of explosive substances were recovered. The apprehended accused disclosed the name of the petitioner and others. It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.31297 of 2015 (2) dt.31-07-2015 2/2 petitioner that recovery has not been made from the petitioner and only on confession of co accused name of the petitioner sprang up. More over, similarly situated co accused has been granted bail by the learned court below.
Considering the fact that the petitioner is accused in two other cases, this court is not inclined to grant anticipatory bail to him but the fact that no recovery has been made from the petitioner constitutes ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Sasaram (Mufassil) P.S. Case No. 821 of 2014 pending in the court of learned CJM, Rohtas at Sasaram.
This application is disposed of with the aforesaid observation/direction.
