JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is seeking regular bail in Khagaria (Mufassil) P.S. Case No. 04 of 2017 registered under Sections 147, 148, 149, 341, 324, 307, 353, 120(B) of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that although there is an allegation of firing 8-9 shots against the named accused in the F.I.R., however, the informant suffered only one injury, that too, in his leg. There is no specific allegation of firing and causing injury to the informant against this petitioner. The petitioner has got no criminal antecedent. Learned counsel further submits that the SHO, who is himself the informant in the present case, has falsely implicated the petitioner.

Patna High Court Cr.Misc. No.36275 of 2017 (2) dt.10-08-2017 2/2 Learned A.P.P. for the State opposed the prayer for bail but accepts the factual position that there is no specific allegation against this petitioner.

This being the position, let the petitioner, namely, Sitaram Singh, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S. Case No. 4 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
