The petitioner, in the present case, is seeking regular bail in connection with Patarghat Saur Bazar ( Patarghat OP) P.S. Case No.566 of 2017, registered for offences alleged under Section 25 (1-b) a/26/35 of the Arms Act.

It is submitted on behalf of the petitioner that as per the allegation he was caught with country made pistol and five live cartridges. It is submitted that the petitioner is in custody for over six months by now. Learned counsel for the petitioner further, submits that even though there is one case against the petitioner, as stated in paragraph 3, he is on bail in the said case. Learned A.P.P. for the State is present.

No.33336 of 2018 (2) dt.14-06-2018 2/2 Considering the facts and circumstances of the case, the petitioner is said to be in custody for over six months and that the investigation of the case is complete, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Patarghat Saur Bazar ( Patarghat OP) P.S. Case No.566 of 2017, subject to the conditions under Section 437(3) Cr.P.C. The petitioner shall be obliged to provide one bailor from amongst his blood relations having no criminal antecedent. If the petitioner is found involved in similar offence again, the prosecution would be free to file an application for cancellation of his bail.
