JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sahiyara P.S. Case No. 64 of 2018 for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged liquor was recovered from one motorcycle, bearing Registration No. BR 30A- 1946, disowning the ownership of the motorcycle from where the liquor was seized. He further submits that the seizure-list of the wine was not in accordance with law and due to suspicion the petitioner has been made accused in this case. The petitioner is in custody since 13.04.2018. Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds

Patna High Court Cr.Misc. No.33602 of 2018 (2) dt.05-06-2018 2/2 of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd- cum- Special Judge, Sitamarhi in connection with Sahiyara P.S. Case No. 64 of 2018.
