JUSTICE HARISH KUMAR ORAL ORDER 22-09-2023 The petitioner presses the present application for restoration of CWJC No. 21483 of 2018, which stood dismissed for non prosecution vide order dated 02.03.2021 passed by a learned Bench of this Court.

2. It is submitted on behalf of the petitioner that on account of indisposition, the learned counsel for the petitioner, who was representing on behalf of the petitioner, could not appear before the Hon'ble Court, which resulted into dismissal

Patna High Court MJC No.468 of 2022(3) dt.22-09-2023 2/2 of the writ petition for non prosecution.

3. Learned counsel for the respondent, State as well as Accountant General submit that on account of sheer negligence on the part of the petitioner, the matter stood dismissed, as earlier, thrice, none had appeared in the matter, thus on the fourth occasion, the matter stood dismissed for non prosecution.

4. In view of the averments made in the application and the submissions advanced on behalf of the petitioner, the present restoration application stands allowed for the ends of justice.

5. Let CWJC No. 21483 of 2018 is restored to its original record.
