2. The petitioners have preferred this application for grant of regular bail in connection with Ratanpura P.S. Case No. 14 of 2023 in NDPS Case No. 15 of 2023 dated 27.02.2023 registered for the offences punishable u/ss 8/20 (b) (ii) (C)/ 22 (C)/ 29 of the NDPS Act.

3. As per the prosecution case, police apprehended three persons who disclosed their names as, Ranjeet Kumar Mehta, Anil Sada and Davendra Sada. On search of the apprehended persons three mobile phones were recovered. Thereafter, on search, eight sacks were recovered from which total 238 kgs. ganja was recovered. Further, the co-accused, Ranjeet Kumar Mehta disclosed the name of persons who fled away as Chotu Mukhiya, Arjun Sada and Pankaj Kumar.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioners. The apprehended persons disclosed the name of the petitioners. The other co-accused person has already been granted bail by this court vide order dated 15.04.2025 passed in Cr. Misc. No. 9872/2025. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 29.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners by submitting that the seized contraband is commercial quantity.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Ratanpura P.S. Case No. 14 of 2023 in NDPS Case No. 15 of 2023.

7. The application stands allowed.
