JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.
Patna High Court Cr.Misc. No.17287 of 2015 (2) dt.20-05-2015 In the background of land dispute it has been alleged that all the petitioners including others having variously armed came at the Darwaja of informant, made indiscriminate firing. Thereafter, they have gone to Plot No.50/457/56 where brother of informant had gone to sow who also escaped therefrom in order to save his life. Then thereafter the accused persons also forcibly came over Khesra No.27, 223, 231, 234, 235, 226.
It has been submitted on behalf of the petitioners that informant happens to be a Ex-mukhiya while one of the accused, petitioner no.1, Ram Narayan Yadav happens to be the present mukhiya and on account of political rivalry, instant case has been registered. Furthermore, it has also been submitted that there happens to be land dispute amongst the parties and on account thereof, it is a fit case wherein petitioners should be granted an anticipatory bail. At the other end the learned Additional Public Prosecutor opposed the prayer.
After going through paragraph 3 of the pleading, it is apparent that all the twenty-nine petitioners have got a chequered history and therefore, indulge in the present mode of occurrence appears to be more probabilised. However, allegations happen to be omnibus without causing injury to anybody though mischief has been alleged.
That being so, petitioners are directed to surrender
Patna High Court Cr.Misc. No.17287 of 2015 (2) dt.20-05-2015 before the learned lower court with a prayer for regular bail which the learned lower court will consider in light of aforesaid finding.
With the aforesaid observation, instant petition is disposed of.
