JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sahajitpur P.S. Case No. 14 of 2017, dated 26.02.2017, instituted for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

The petitioner and his father are alleged to have assaulted the informant. So far as the petitioner is concerned, the specific accusation is that on the orders of his father, he tied a cloth around the neck of the informant and pressed it for causing his death. The injuries suffered by the

Learned counsel for the petitioner has submitted that earlier, the brother of the petitioner had filed a case against the informant and others. The father of the petitioner is a businessman of the area and the informant, who happens to be a co-villager, is on litigating terms with him.

Regard being had to the aforesaid facts as also taking into account the clean antecedent of the petitioner, above named, he is directed to be released on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, Saran at Chapra in connection with Sahajitpur P.S. Case No. 14 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
