JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2019 This is an application for grant of anticipatory bail in connection with Chapra Town P.S. Case No. 11 of 2019, disclosing offences under Sections 188, 120B, 34 of the Indian Penal Code and Section 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

As per the F.I.R. during the course of raid, two accused persons were apprehended and they disclosed the name of the petitioners and other accused persons. It further appears that during the course of raid, 2682.36 liters of foreign liquor has been recovered and a motorcycle was also recovered. Submission of the learned counsel for the petitioner is that the recovered motorcycle does not belong to the petitioner and except that there is nothing against the petitioner. Heard learned A.P.P. also, who opposed the prayer for

Patna High Court CR. MISC. No.15477 of 2019(3) dt.01-07-2019 2/2 bail on the ground that said motorcycle was recovered is of the petitioner and he has criminal antecedent also. Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail, which will be considered by the learned court below, on its own merit, without being prejudiced by order of this Court, and if possible, be disposed of on the same day.
