Earlier the bail of the petitioner was rejected vide order dated 04.10.2018 in Cr. Misc. no. 51066 of 2018 with liberty to renew his prayer for bail after completion of six months of custody.

The petitioner seeks regular bail in connection with Nathnagar (Lalmatiya) PS case no. 380 of 2016 registered for the offence punishable under Sections 394, 307, 395, 397/34 of Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is languishing in custody since 04.12.2017 and has completed more than six months of jail custody. It is further submitted that similarly situated co-accused persons

Patna High Court CR. MISC. No.16629 of 2019(2) dt.02-04-2019 2/2 have been granted bail by a coordinate Bench of this Court vide order dated 08.10.2018 and 30.01.2019 passed in Cr. Misc. no. 59749 of 2018 and Cr. Misc. no. 3853 of 2019 respectively. Lastly, it is submitted that the petitioner is accused in some other cases but he is on bail in the said cases. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Bhagalpur in connection with Nathnagar (Lalmatiya) PS case no. 380 of 2016.
