Imteyaz Ahmad, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Giriyak (Katrisarai) P.S. Case No. 260 of 2019 dated 20.07.2019 instituted for the offences under Section 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
During the police patrolling, two persons managed to run away when they were signalled to stop. From that place, 15 litres of liquor allegedly thrown by those miscreants was recovered It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.14825 of 2020(2) dt.11-06-2020 2/2 that he is not named in the First Information Report but he is the owner of the vehicle which was seized by the police. The vehicle was taken by some of the friends of the petitioner for catering to an urgent need. The petitioner is an elderly person and has clean antecedent.
Considering the aforesaid facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge Judge -II-cum-Special Judge (Excise), Nalanda at Biharsharif, in connection with Giriyak (Katrisarai) P.S. Case No. 260 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
