JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-01-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail on behalf of petitioners, namely, Ashok Yadav, Uday Yadav and Ranjit Yadav in a case registered for the offences punishable under Sections 341,323,379/36 of the Indian Penal Code and 4 of the Daain Act.

As per the prosecution story, as contained in complaint petition filed by the complainant, the accused persons called her Daain and assaulted her variously. It is also alleged that the accused persons took away a silver chain with locket worth Rs.

Patna High Court Cr.Misc. No.31659 of 2014 (4) dt.30-01-2015 3000/- from the neck of the complainant.

Learned counsel for the petitioners submits that no injury was found on the person of the complainant. He further submits that complaint case was instituted out of certain personal dispute between the parties.

In view of the nature of allegations and in view of the submissions as above, the petitioners above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Complaint Case No. 356-C/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
