It is submission of counsel for the petitioner that his claim for non-practicing allowance made by Annexure 4 dated 01.05.2012 has still not been acted upon. Claim has been made in light of Resolution of the Government of Bihar dated 11.08.2011.

In view of said submission, since admissibility of the claim has to be examined by respondent no.2, and this court is not called upon to make any adjudication at this stage, writ

Patna High Court CWJC No.9478 of 2015(2) dt.13-11-2019 2/2 petition is disposed of with direction to respondent no.2 (Commissioner-cum- Principal Secretary, Animal and Fisheries Resources Department, Bihar, Patna) to take a final decision on the claim of the petitioner within a period of three months from the date of receipt/production of a copy of this order. It is made clear that if any financial dues are found admissible, same should also be paid within the aforesaid period.
