The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 357, 307, 504, 506, 435 of the Indian Penal Code and B/415 of the Prevention of Damage of Public Property Act.

The prosecution case in short is that the accused persons after making unlawful assembly started pelting stones on police party and also blocked the traffic. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.2.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is

Patna High Court CR. MISC. No.18995 of 2019(2) dt.11-04-2019 2/2 alleged to one of the persons who were protesting against the police. Altogether 19 persons are named in the F.I.R. along with 60 unkown persons. General and omnibus allegation has been made against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 24 of 2018.
