JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 379,384,504 and 354/34 of the Indian Penal Code.
It is alleged by the Headmaster of the school that the petitioners being Chairman and husband of the Assistant Secretary of Vidyalaya Shiksha Samiti of Primary School, Madhuaha Brit abused the informant, pressed her mouth and took away the official paper and register from the office and demanded two lacs rupees as extortion.
It is submitted by learned counsel for the petitioners that during investigation the accusation was found false and charge
Patna High Court Cr.Misc. No.32603 of 2014 (2) dt.06-02-2015 sheet was submitted under sections 504/34 IPC but differing with the final form, charge sheet was submitted.
Considering the fact that final form was submitted by the police finding the case untrue for the major offences alleged, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana at Motihari, East Champaran in connection with Rajepur P.S. Case No. 18 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
