JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

It is alleged that the petitioner being the daughter-in-law of the victim caught hold of her father-in-law when the husband of the petitioner namely Shivnath Rai @ Vishwanath Rai assaulted with dagger on the neck and waist of the father-in-law of the informant who subsequently succumbed to the injuries. It is submitted by learned counsel for the petitioner that the petitioner is a lady and the accusation of assault is against the co-accused Shivnath Rai.

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.24724 of 2015 (2) dt.08-07-2015 2/2 Accordingly, the application is rejected in connection with Pusa P.S. Case No. 55 of 2014 pending in the court of learned JM, 1st Class, Samastipur.
