The petitioner seeks bail in Complaint Case No.422(C) of 2018, registered under Sections 498(A) of the Indian Penal Code and under Sections 3⁄4 of the Dowry Prohibition Act.

The complainant, wife of the petitioner, alleged in her complaint petition that her marriage was solemnized with the petitioner on 13.05.2014 and she lived happily with her husband for 11⁄2 years. She became pregnant but later on her husband and others began to demand additional dowry and due to nonfulfillment of demand of dowry, she was driven out from the house. It is alleged that the petitioner being the husband drove

Learned counsel for the petitioner submits that the petitioner never tortured his wife. The petitioner is in jail since 16.01.2020. The petitioner has already remained in jail for about five months.

The learned Additional P.P. however, opposed the prayer for bail.

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the petitioner has already remained in jail for about five months, petitioner, namely, Aakash Sah is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui in connection with Complaint Case No.422(C) of 2018.
