JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 504 and 342 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of making assault and abusing the informant by calling caste name.

It is submitted by learned counsel for the petitioner that at earlier point of time, on the application of the petitioner, 107 Cr. P.C. proceeding was initiated as the informant encroached the land of the informant and subsequently the informant has retracted from his initial version and filed a petition to that effect before the learned court below.

No.26037 of 2015 (2) dt.02-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, Patna in connection with SC/ST P.S. Case No. 01 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
