The appellant is apprehending his arrest in connection with Lalganj P.S.Case no.347 of 2018 , registered for offences punishable under Sections 304/34 of the Indian Penal Code and Section 3(1)(r)(s), 3(ii)(v) of SC/ST (Prevention of Atrocities) Act.
Allegation against the appellant is that without being a qualified Doctor, he has conducted operation upon the wife of the informant and due to which she died. Submission of the learned counsel for the appellant is that he has falsely been implicated in this case and later on the informant realizing the same has compromised the case.
Heard learned Special P.P., who has opposed the prayer for bail stating that the materials shows that the electronic equipments and other instruments were recovered from the place of occurrence and the appelant was not a qualified Doctor.

APP (SJ) No.939 of 2019 dt.03-04-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail rather let the appellant surrender before the learned Special Judge within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned special judge on its own merit .
Accordingly, this appeal is dismissed.
