====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-02-2022 Heard learned counsel for the petitioner and learned APP for the State.
Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.
It is alleged that this petitioner assaulted the
Patna High Court CR. MISC. No.27364 of 2021(2) dt.01-02-2022 2/3 informant with iron rod as a result of which, the informant received head injury. The injury of the informant has been found to be grievous in nature. It is submitted by learned counsel for the petitioner that in the background of some land dispute, the present F.I.R has been registered. The petitioner and the informant are neighbour. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the fact that the injury of the informant has been found to be grievous in nature, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.
However, if the petitioner surrenders within a period of four weeks and pray for regular bail, the same may be considered by the learned Court below without being prejudiced by the order of this Court.
With the aforesaid observation and direction,
Patna High Court CR. MISC. No.27364 of 2021(2) dt.01-02-2022 3/3 the petition stands disposed off.
