04-07-2018 Heard Sri Gagan Deo Yadav, learned counsel for the petitioner and Sri Chaubey Jawahar, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Khajauli P.S. Case No. 33 of 2017 registered for offence under Sections 393, 384, 386 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that at the time of commission of crime, petitioner was inside the jail and as such, there is no reason for involvement of the petitioner and accordingly, a prayer has been for granting bail to the petitioner.

However, learned Addl. Public Prosecutor has drawn my attention to statement made in paragraph - 3 of the petition

Patna High Court Cr.Misc. No.33820 of 2018(3) dt.04-07-2018 2/2 and he submits that petitioner is habitual offender regarding commission of serious offences.

I have also perused the material on record and after going through the same, considering the criminal antecedent of the petitioner, I am of the opinion that there is no reason to pass favourable order.

Dismissed.
