The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 409, 420 and 120B of the Indian Penal Code.

As per the prosecution case, the petitioner who happens to the Chairman of the PACS concerned is stated to have withdrawn a sum of Rs.3,21,000/ for construction of the rice mill-cum-gasifier but did not complete the construction work.

It is submitted by learned counsel for the petitioner that from the F.I.R. itself, it would transpire that the work had been done by the petitioner and the only dispute related to part of the work which as per the F.I.R. was not completed whereas as per the case of the petitioner much more work than the

Learned counsel for the petitioner refers to the letter dated 7.9.2020 (Annexure-3) to the petition which has also been referred to in the case diary. The petitioner is in custody since 10.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation, the petitioner having remained in custody for over 11 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Chenari P.S. Case no.108 of 2017 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram, District-Rohtas.
