ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272/273 & 47 (A) of the Excise Act.

Learned counsel for the petitioner submits that altogether misconceived allegations have been levelled against the petitioner. In fact, the petitioner is a valid licence holder authorised up to 31.12.2016 for manufacture and sale of Homeopathy medicine. Considering the nature of allegations made and that the petitioner is a valid licence holder and further that the petitioner is a manufacturer of Homeopathy medicine and there is no allegation

Patna High Court Cr.Misc. No.21667 of 2016 (3) dt.05-08-2016 P2/2 against him regarding sale of country-made liquor, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Purnea, in connection with Sadar P.S. Case No. 90/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
