Prayer for bail has been renewed on behalf of the petitioner who is accused of Sherghati (Dobhi) P.S. Case No. 152 of 2014 registered under Sections 302, 201 and 34 of the IPC. It is submitted that the allegation is based on suspicion. The petitioner is in custody since 24.07.2016. Learned APP submits that on 29.11.2016, the prayer for bail made on his behalf was rejected vide order at Annexure-1 without granting any relief.

Learned counsel for the petitioner also submits that some of the other co-accused have been granted bail by this Court Having heard the parties and considering the facts and circumstances of the case, prayer for bail made on behalf of the

Patna High Court Cr.Misc. No.36299 of 2017(2) dt.13-10-2017 2/2 petitioner is rejected. However, the petitioner shall have liberty to renew prayer for bail in the Court below itself if the trial does not record adequate progress within 10 months from the date of receipt/communication of a copy of the order.
