JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khaira P.S. Case No. 104 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation as per FIR is that son of the informant was called by the petitioner, Subhasha Devi and others and thereafter dead body of the deceased was found and informant suspects the hands of the petitioner and others in killing his son. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and except suspicion there is nothing against him and and co-accused Subhasha Devi has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 21.1.2019 passed in Cr.Misc.No. 72954 of 2018.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Khaira P.S.Case No. 104 of 2018, corresponding to G.R.No. 762 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation.
