ANJANA MISHRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioner no.1 being the elder brother-in-law (Bhaisur) of the husband of the deceased, petitioner no.2 being the Gotani and petitioner no.3 Shila Devi is married Nanad of the deceased are apprehending their arrest in Bariyarpur P.S. Case No.64 of 2010 for the offences under Sections 304(B), 498(A), 201 of the I.P.C. and Section 3 and 4 of the Dowry Prohibition Act.

It is submitted on behalf of the petitioners that earlier unnatural Death Case being U.D.Case No.29/09 had been registered and the complainant had also filed the present complaint case. The specific allegation is against the husband and not against

Patna High Court Cr.Misc. No.32429 of 2014 (2) dt.21-01-2015 2/2 these petitioners. It is also submitted that earlier father-in-law and mother-in-law of the deceased have already been extended anticipatory bail vide order dated 31.01.2014 passed in Cr.Misc. No.32111/13 as contained in Annexure-2.

Considering the aforesaid submissions and also the fact that there is no specific allegation against these petitioners, let the aforesaid three petitioners, in the event of their arrest or surrender before the court below within two weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Munger, in Bariarpur P.S.Case No.64/10 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
