JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Sitamarhi P.S. Case No. 150 of 2017, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. The informant, mother of the deceased alleged that she married her daughter 15 years ago with Md. Chand but he husband and family members of her husband started demanding additional demand of dowry. She got information that her daughter was burnt to death.

The learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner has no manner of concern with the family affairs of the deceased and the petitioner is not member of the in-law's family of the

Patna High Court Cr.Misc. No.33578 of 2018 (2) dt.07-06-2018 2/2 deceased, he is the villager of the in-law's family of the deceased. Moreover, similarly situated co-accused persons have been granted bail by another bench of this Court vide order dated 15/01/2018 passed in Cr. Misc. No. 360 of 2018. Considering the facts and circumstances of the case, let the petitioners above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 150 of 2017, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
