The petitioner is apprehending arrest in connection with Kako P.S. Case No. 268 of 2019 for offences under Sections 147, 149, 341, 307, 379, 504 and 506 IPC. Allegation against the petitioner is that he has assaulted the informant.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Both sides have entered into free fight and both sides received injuries. The petitioner has also sustained injuries. There is case and counter case.

Considering the fact that there is case and counter case and both sides received injuries, the Court is inclined to

Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-I, Jehanabad in connection with Kako P.S. Case No. 268 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C.
