The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273 and 120B of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, on a raid being conducted it is stated that large quantity of IMFL was recovered from a godown. Some accused persons including the two petitioners herein were caught and it is stated that it was disclosed that the godown belonged to one Ram Krishna Agrawal.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.26666 of 2021(3) dt.08-12-2021 2/2 petitioners that the petitioners have been falsely implicated in the case. The petitioner no.1 being an employee of the security agency was sent by Adya Security Services Pvt. Ltd. as an employee to the godown as a guard where he was posted as a gatekeeper. Neither he had any authority nor was he aware of the goods being carried in the vehicles or stored in the godown. The petitioners are in custody since 28.1.2021 and have no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioners not having any criminal antecedent, the Court directs both the petitioners to be enlarged on bail in connection with Sadar P.S. Case no. 46 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnea. (Partha Sarthy, J) Bibhash/- U
