JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 10 of 2020 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

It appears that 56.520 litres of liquor was recovered from the ground floor of one New Shivam Nursing Home. It further appears that a local eatery is being run on the ground floor whereas the first floor of the building is occupied by the nursing home employees. The petitioner though is the owner of the eatery which runs on the ground floor but such eatery is being managed by his paid staff. Recovery is from beneath the staircase.

Considering the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Excise Case No. 10 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
